Malicious Prosecution

Question

I am being charged over $13,000 for board from when I was held in a County Jail for 13 months on a bond that was too high for me to come up with but the charges I was being held on were ultimately all dropped then refiled completely different and I was released on an OR bond. If I had been charged properly to begin with I wouldn't have had to stay in jail so long. How can I appeal that bill? There are other things on the bilI I want to question, too.

Answer

Unfortunately you really have no avenues to solve your problem. The only one that comes to mind is a lawsuit for malicious prosecution. You would have to prove the following That the prosecutor intentionally (and maliciously) pursued a legal action that was brought without probable cause and dismissed in favor of the victim of the malicious prosecution. The police and state are generally protected by sovereign immunity. These are high hurdles to climb. I have to say it is unfortunate what has happened to you and very hard to solve.

I took metro-link without paying , that is to say fare violation,how can I be punished?

Answer

In looking up the city ordinances, the punishment for any violation of the section that contains fare violations is as follows:
716.180 - Penalties.
—Every person who shall be convicted of a violation of any of the provisions of this chapter shall be fined not more than one thousand dollars ($1,000.00) or imprisoned in the St. Louis County Jail for not more than one year, or punished by both such fine and imprisonment.
Now it appears that "fare jumping" is a fine of up to $82.50 and a quick google search displayed several lawyers in St. Louis will take care of it for as little as $35.00.

Warrant Validity

Is a warrant legal that contains the wrong , social security number

Answer

This answer all depends upon how necessary the social security number is to what is attempting to be searched and seized. The general answer is yes, the warrant is valid. Minor technical discrepancies(and in some cases major discrepancies in my opinion) have been overlooked by the court. The courts look to the intent of the warrant and how it is used. A wrong number may just be a technical error or it may mean the wrong person. If meaning wrong person then the warrant is not valid.

Age of Consent in Missouri



Q: If a 16 almost 17 year old gets pregnant by a23 year old that she is in a relationship with could he get in trouble?

They most certainly can get in trouble. The crime is statutory sodomy Section 566.064 of the missouri revised statutes states the following. 566.064. 1. A person commits the crime of statutory sodomy in the second degree if being twenty-one years of age or older, he has deviate sexual intercourse with another person who 

is less than seventeen years of age. 

2. Statutory sodomy in the second degree is a class C felony.

Payday loan or loan shark?


Loan sharks are Known to be cheaper than some payday lenders in Missouri. 

Missouri allows short term loans(14-31 days) under (Mo. Rev. Stat. §§ 408.500)  According to the Missouri department of finance a 75 percent cap on interest and fees on the initial loan and interest can apply daily and must be posted.  This means a loan of $100, if not paid back the next day, will cost you $75 just in fees and interest!!!  This cap was only placed a few years ago and a measure to limit it at 39% was not even allowed to ballot.   So in short, avoid payday loans and loan sharks for that matter, save your money and your legs.
